Your Rights and Questions

What are my rights if I am stopped by police?

You have the right to remain silent and the right to an attorney. It is best to stay calm, keep your hands visible, and say that you wish to remain silent and want to speak with a lawyer.

Can I seal or expunge my juvenile record?

In most cases, yes. Sealing a record means it is mostly hidden from the public. Expunging means that it is destroyed. The rules depend on the type of offense and your age, so talking to a legal aid attorney is the best way to start.

How do I find a lawyer if I can't afford one?

Harris County has several legal aid organizations that provide free help to youth and low-income residents. Check the legal resources section above to help!

Can the police search my backpack, phone, etc?

No, the police cannot search your personal belongings without your consent, nor can they search without a warrant or a valid legal exception. Keep in mind that these rights do change if you are on school property.

What should I do if i get investigated by police?

Even if you are not directly involved in the investigation, you should still have a lawyer speak for you. This is for your saftey because even if you didn't do anything wrong, confusions can happen.
